The preliminary hearing in the murder case involving singer D4vd has been postponed after prosecutors and defense attorneys told a Los Angeles judge they still need more time to review a large volume of evidence.
During a hearing Tuesday morning at the Clara Shortridge Foltz Criminal Justice Center in downtown Los Angeles, Judge Charlene Olmedo approved a request to continue the proceedings. The preliminary hearing, previously scheduled for May 26, has now been moved to June 29. A separate status hearing is scheduled for June 17.
D4vd, whose legal name is David Anthony Burke, has pleaded not guilty in connection with the death of 14-year-old Celeste Rivas Hernandez.
Case
Prosecutors allege that the teenager’s dismembered remains were discovered inside a Tesla linked to Burke in September 2025.
Authorities have not publicly disclosed all details surrounding the investigation, but the case has drawn significant attention because of the seriousness of the allegations and Burke’s public profile as a musician.
The court hearing Tuesday focused primarily on the large amount of digital evidence still being exchanged between prosecutors and the defense team.
Discovery
Deputy District Attorney Beth Silverman told the court that prosecutors have already provided more than 10 terabytes of discovery materials to Burke’s attorneys.
According to prosecutors, the evidence includes:
| Evidence Type | Details |
|---|---|
| Digital records | iCloud data |
| Police evidence | LAPD reports |
| Forensic materials | DNA and lab reports |
| Media files | Photos and videos |
| Legal records | Arrest documents |
Silverman said the discovery process is still ongoing and estimated the total volume of evidence could eventually exceed 40 terabytes.
She explained that prosecutors have been uploading files through the Evidence.com platform since last week because of the size and complexity of the materials involved.
“Discovery will take a few months to complete because there is so much,” Silverman told the court.
Concerns
Silverman also raised concerns about repeated scheduling changes connected to the case.
She told the judge prosecutors had already coordinated witness schedules based on earlier hearing dates and warned that ongoing delays create difficulties for the prosecution team.
“We want to make sure we are not doing this over and over,” Silverman said during the hearing. “It holds us hostage.”
The prosecution requested a schedule that would allow both sides sufficient time to review evidence while reducing the possibility of additional postponements.
Defense
Defense attorney Blair Berk acknowledged that her team is still waiting for certain reports and summaries related to the prosecution’s theory of the case.
“It’s hard to argue what you don’t know yet,” Berk told the court.
She also noted that some discovery concerns remain unresolved, including outstanding DNA evidence and written investigative reports.
However, Berk indicated that many of the remaining issues could likely be handled informally between the two sides without requiring additional court intervention.
Burke appeared calm throughout much of the hearing, according to courtroom observations. At one point after proceedings concluded, he appeared to wink toward Berk while being escorted from the courtroom.
Hearing
Judge Olmedo approved the continuance but indicated the court would continue monitoring the pace of discovery closely moving forward.
She said future scheduling requests would be reviewed carefully, although she did not rule out the possibility of further delays if evidence disputes continue.
The judge also discussed the expected length of the upcoming preliminary hearing, which attorneys estimated could last between five and six days.
A preliminary hearing is used to determine whether prosecutors have enough evidence to move a criminal case toward trial.
Timeline
The next major dates in the case include:
| Court Event | Date |

| Status hearing | June 17 |
| Preliminary hearing begins | June 29 |
The investigation and court proceedings remain ongoing.
